The Post-Judgment Phase of Debt Collections

Once the court gives us its judgment, you expect to be paid -- case closed. Unfortunately, this does not always happen so easily. It is here that we move to another phase of the Collection Process.

Skilled at Finding the Money

If you do not know where the debtor is employed or where he or she banks, as a lawyer, Joe Perry Redd can at this point force the debtor (or an officer of a corporation) to come to our office and produce bank records. He can also force a debtor to testify under oath and penalty of perjury as to his or her employment, bank accounts and property.

In the post-judgment phase, we can now begin to garnish wages, bank accounts and to place liens on property. If the debtor refuses to cooperate, we can obtain a court order telling them to cooperate. If the debtor still fails to cooperate, we can ask the court to jail the debtor for contempt until they talk.

If the debtor has transferred the house into his wife's name, we may be able to get this reversed. Georgia law allows attorney Joe Redd to also take the depositions of "third parties," even if not liable on the debt, if he believes they have information about the debtor's assets. This has proven to be quite effective as well.

The Advantages of Skip Tracing

Reddlaw has the capability to do in-house skip tracing with full access to credit bureau files as well as other services used to locate debtors and their assets.

If outside sources are needed, we maintain relationships with excellent tracing and asset location services, but these are only used with the permission of you, the client, as you are responsible for all costs of $50 or more.
